I started on a dictionary of Real Estate terms last week and only got a far as the A’s.  Yikes.  Well, this is a learning experience and I will give you a few terms per week in hopes that the definitions and then practical explanation will help you if you are a buyer or seller in the Real Estate Market in Taos, NM.

 

Let’s skip to some terms which are often repeated in a normal real estate contract.

Sales Contract: A contract by which a buyer and seller agree to the terms of the sale of real property. 

This means that both buyer and seller agree on a price for the property, closing date of the sale and to certain contingencies outlined in the purchase agreement.  For example, one contingency of the sale may be the ability of the buyer to obtain financing.  Another common contingency may be having a home inspection completed.  In New Mexico, septic inspections must be done prior to selling a property.

Closing Date:  A date on which a buyer pays for the property and the seller delivers the deed. 

This is the day that the buyer becomes the new owner of the property.  This is a date agreed upon by buyer and seller in the Sales Contract.  This original date from the contract, can be changed, if there is a signed agreement between buyer and seller.

 

Contingency:  A contractual Clause that calls for an uncertain future event to be done or to occur in order for the contract to be binding. 2. A condition specified in the purchase contract. 

Contingencies which are outlined in the New Mexico purchase agreement include the buyers ability to get financing for the purchase, inspections of documents including survey, septic etc., home inspection, clarity of title, to name a few.  A buyer may have their agent include other contingencies such as the sale of another property owned by the buyer.  These contingencies should be written and clearly put forth in the purchase contract.  If you have any questions about any of these or other contingencies, just give me a call!

Inspection:  A physical scrutinizing of documents or property done to assure correctness of paperwork such as loan papers, compliance with codes,  or absence of safety hazards etc.

Normally, a buyer will have a home inspector, thoroughly check out a property and give a written inspection report to a buyer regarding the property the buyer trying to buy.  An inspector will typically inspect both the interior and exterior of a home and will not any problems which are evident in a property.  An example of a problem would be plumbing issues, electrical issues, poor roofing, foundation etc.  I strongly encourage all of our buyers to have an inspection done prior to closing on a property.

Autumn Leaves

In the last few weeks, I have been fortunate enough to write some purchase agreement contracts for buyers who want to purchase properties in the Taos, New Mexico area.

As I sat down with Buyers to prepare the contracts, I realized that so many of the terms used in a typical Real Estate Purchase Agreement sound like a foreign language to most people who are not in the real estate business.

 

I found an online Real Estate Dictionary and started looking at the terminology that is used in real estate.  Wow! for all of you non real estate mortals, I am sorry.  A purchase contract is such a “mess” (as they say in Georgia, where I grew up) of terms.

I hope that by explaining some of the definitions for these terms, that your purchase agreement process will be a little more understandable.  I plan to give you the legal explaination and then add some comments to try and help you understand the terms.  Just so you know, I am not an attorney.

I am going to start with an alphabetical approach, but if any of you have questions down the alphabet, just send me an email and I will skip a few letters and explain some of this jargon in laymen’s terms.

 

The A’s:

Agent

A natural or legal person who has either expressed or implied authority to act for and represent another party known as the principal typically in business matters.

Well what does this mean? Simplistically, as your agent, I will write your purchase contract for you,  will cover the basic terms of the contract with you, will present the contract to the seller’s agent, and will walk you through the negotiations of that contract, help you with the process of buying the property.  In this process of purchasing a property, there are some logical steps to follow .  An example of one step would having the property inspected by a home inspector. (More on this later) I already have lots to say about this procedure, but will wait for a later date to go through that.

Agency Disclosure

A written declaration signed by a prospective buyer or seller informing that party of the role that the broker is playing in a specific transaction.

Well, hmmm.  As an agent, do I respresent you and the seller or just you as the buyer ?  Important to know.  Also do I have any material (ownership) in the property.  Make sure you understand who the players in this transaction are.

Appraisal

1. A ”defensible” and carefully documented opinion of value most commonly derived using recent sales of comparable properties by a licensed, professional appraiser. 2. A statement of value

If you are getting a loan in order to purchase a property, the lender (bank, mortage broker etc) will want the property appraised or evaluated by a licensed appraiser.  This is done in order for the lending institution to feel secure that the property that you are going to buy, is worth the amount of money that they are willing to lend you for that property.  If you are fortunate enough to be a cash buyer, then you may also want an appraisal done on the property.

I hope some of these definitions help you to understand some of the terminology used in the standard New Mexican Real Estate Purchase contract.  Realtors are not attorneys.  For further explaination of legal terms, talk with your favorite Legal guide.

Understanding the terms and the process for buying real estate makes the whole transaction seem a lot more fun and exciting.

10.  World class fishing is available in Taos and in the surrounding areas.  Come check out the “secret” waters around Taos and the Rio Grande River.

This is just the start of the list.  Housing is available and priced to sell, Loans rates are at an all time low, There are tons of activities indoor and outdoor to keep you happy and occupied.  Cultural events happen often and are often free to attend.  And the weather is good!
